3. Legal basis for processing (GDPR)
Under the General Data Protection Regulation (GDPR), we process your personal data based on the following legal grounds:
| Processing activity | Legal basis |

| Account creation and management | Performance of contract (Art. 6(1)(b)) |
| Payment processing and billing | Performance of contract (Art. 6(1)(b)) |
| Sending transactional emails (for example clips ready, security notices) | Performance of contract (Art. 6(1)(b)) |
| Analytics and service improvement | Legitimate interest (Art. 6(1)(f)) |
| Fraud prevention and security | Legitimate interest (Art. 6(1)(f)) |
| Marketing communications | Consent (Art. 6(1)(a)) |
| Compliance with legal obligations | Legal obligation (Art. 6(1)(c)) |
4. How we use your personal data
We use your personal data for the following purposes:
- Service delivery: Processing your submissions, generating transcripts and layouts, rendering clips, and publishing to connected platforms when you ask us to
- Account management: Creating and maintaining your account, subscriptions, and credits
- Payment processing: Managing billing through Stripe
- Communications: Transactional email and, with your consent, marketing
- Service improvement: Analyzing aggregate or anonymized usage to improve performance and features
- Security: Detecting and preventing fraud, abuse, and unauthorized access
- Legal compliance: Fulfilling legal obligations and protecting our rights
Important: We do not use your user content (videos, audio, transcripts, or exported clips) to train our own AI or machine learning models. Your content is processed to deliver the Services to you. Third-party AI providers we use (for example OpenAI and Deepgram) process data under their API and data processing terms, which restrict use of customer content for model training as described in their policies.
5. AI processing & third-party AI providers
Our Services use artificial intelligence to process your content. This section summarizes what data may be sent to AI providers and how it is handled.
5.1 Deepgram (speech-to-text)
- Data sent: Audio extracted from the source media we process for you
- Purpose: Generating transcriptions with timing (and related speech metadata we configure)
- Retention by Deepgram: Processed via their API under their terms; audio is not retained for training after processing as described in their documentation
- More info: Deepgram Privacy Policy
5.2 OpenAI (language and analysis models)
- Data sent: Text derived from transcripts and related metadata about your project — we do not send raw video files to OpenAI for typical language-model tasks; other pipelines may use structured visual or timing signals as configured in our stack
- Purpose: Editorial planning, highlight suggestions, hook text, captions timing assistance, and similar features
- Retention by OpenAI: Governed by OpenAI's API data policies (including retention for abuse monitoring where applicable)
- More info: OpenAI Privacy Policy
5.3 Automated processing
Automated systems may propose crops, layouts, segments, or scores. You can review and change outputs before export or publishing. We do not use these features to make solely automated decisions with legal or similarly significant effects about you as an individual within the meaning of GDPR Article 22.
6. Third-party service providers (sub-processors)
We share personal data with service providers who process data on our behalf under appropriate agreements:
| Provider | Purpose | Data shared |
|---|---|---|
| Deepgram | Audio transcription | Audio data |
| OpenAI | AI text analysis and generation | Transcripts, project metadata |
| Stripe | Payment processing | Payment status, email, billing records |
| Cloudflare (R2) | Object storage and CDN | Media files, rendered clips, assets |
| Microsoft Azure | Queues and compute | Job metadata and processing payloads |
| MailerSend | Transactional email | Email address, message content |
| Google Analytics | Website analytics (marketing site) | Usage data; may include IP in accordance with your consent and settings |
When you connect YouTube or other platforms, we exchange data with those services as needed to publish on your behalf. That sharing is initiated by you and is governed by each platform's privacy policy.
7. International data transfers
Clippper AI is based in The Netherlands (EU/EEA). Some providers operate outside the EEA, including in the United States. When we transfer personal data outside the EEA, we use appropriate safeguards such as the EU-U.S. Data Privacy Framework where applicable, Standard Contractual Clauses, or other mechanisms recognized by regulators.
You may request more information about transfers by contacting us at info@clippper.ai.
8. Cookies & tracking technologies
We use cookies and similar technologies for authentication, security, preferences, analytics (where you consent), and to remember choices. You can manage non-essential cookies through our cookie controls and your browser. Blocking essential cookies may affect login or core features.

We retain personal data only as long as necessary for the purposes described in this policy:
| Data type | Retention period |

| User content (source media, clips, transcripts) | While your account is active; removed on a rolling basis according to plan and operations |
| Backup copies | May persist for up to 90 days after deletion from active systems |
| Payment and billing records | Up to 7 years where required for tax and legal obligations |
| OAuth tokens (for example YouTube) | Until you disconnect the integration or delete your account |
| Server logs and analytics | Typically up to 12 months unless a longer period is needed for security |
| Deleted account identifiers | A non-reversible hash of your email may be retained to reduce abuse and duplicate sign-ups |
10. Your rights under the GDPR
If you are in the EEA, the UK, or Switzerland, you may have the right to access, rectify, erase, restrict, port, or object to certain processing, and to withdraw consent where processing is based on consent. You may lodge a complaint with your supervisory authority. In the Netherlands, this is the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).
To exercise your rights, contact us at info@clippper.ai. We will respond within the time required by law and may need to verify your identity.
11. California privacy rights (CCPA/CPRA)

To exercise these rights, contact us at info@clippper.ai.
12. Data security
We implement technical and organizational measures appropriate to the risk, including encryption in transit (TLS), access controls, and secure authentication practices. No method of transmission or storage is completely secure; we work to address incidents promptly.
13. Data breach notification
If a breach is likely to risk your rights and freedoms, we will notify the supervisory authority within 72 hours where the GDPR requires, and notify affected individuals without undue delay when required.
14. Children's privacy
The Services are not directed at children under 16. We do not knowingly collect personal data from children under 16 without appropriate consent. If you believe we have collected such data, contact us at info@clippper.ai.
15. Account deletion
You may delete your account using in-app controls or by contacting us. When you delete your account, we remove or anonymize personal data where we are not required to retain it. Backups may persist for a limited time; billing records may be kept as required by law. Content already published on third-party platforms is not removed by us — manage it on those platforms directly.
16. Changes to this privacy policy
We may update this policy from time to time. We will change the "Last updated" date above. If changes are material, we will provide additional notice as appropriate (for example by email or an in-app message).
